一、第五(wu)十(shi)七條修(xiu)改為:“設(she)立勞務派遣單位應當具(ju)備下列(lie)條件:
“(一)注冊資本不得少(shao)于人民(min)幣(bi)一百(bai)萬元;
“(二)有符合法律(lv)規定的勞務派遣管(guan)理(li)制度;
“(三)法律(lv)、行政法規(gui)規(gui)定的其(qi)他(ta)條件。
“設立勞(lao)務派遣單(dan)位,應當(dang)向勞(lao)動行(xing)(xing)政部門依法辦理(li)行(xing)(xing)政許可;經許可的(de),依法辦理(li)相應的(de)公司登記。未經許可,任何單(dan)位和個人不(bu)得經營勞(lao)務派遣業務。”
二、第(di)六(liu)十三條增加一款,作為第(di)二款:“勞(lao)務(wu)派(pai)遣單(dan)位與(yu)被派(pai)遣勞(lao)動(dong)者訂立(li)的(de)(de)勞(lao)動(dong)合(he)同和與(yu)用工單(dan)位訂立(li)的(de)(de)勞(lao)務(wu)派(pai)遣協議,載明(ming)或(huo)者約定的(de)(de)向(xiang)被派(pai)遣勞(lao)動(dong)者支付的(de)(de)勞(lao)動(dong)報酬應當符合(he)前款規定。”
三、第六十六條修改為:“勞務派遣只能在臨時性、輔助性或者替代(dai)性的工作崗位上實施。
“前款(kuan)規定的(de)臨時(shi)性(xing)(xing)是指用(yong)(yong)工(gong)(gong)單位(wei)(wei)(wei)的(de)工(gong)(gong)作崗(gang)位(wei)(wei)(wei)存續時(shi)間不超過六個月;輔助性(xing)(xing)是指用(yong)(yong)工(gong)(gong)單位(wei)(wei)(wei)的(de)工(gong)(gong)作崗(gang)位(wei)(wei)(wei)為(wei)主營業務(wu)崗(gang)位(wei)(wei)(wei)提供服(fu)務(wu);替代性(xing)(xing)是指用(yong)(yong)工(gong)(gong)單位(wei)(wei)(wei)的(de)職工(gong)(gong)因脫產學習、休假(jia)等原因在該(gai)工(gong)(gong)作崗(gang)位(wei)(wei)(wei)上無法工(gong)(gong)作的(de)一定期間內,可以由被派遣勞動者替代工(gong)(gong)作。”
四、第九十二條(tiao)修改為:“違(wei)反本(ben)法第五十七條(tiao)規(gui)定(ding),未經許(xu)可(ke),擅自(zi)經營勞務(wu)派(pai)遣業務(wu)的(de),由勞動行政部門依(yi)法予(yu)以(yi)(yi)取締,沒收違(wei)法所得,并(bing)處(chu)違(wei)法所得一(yi)倍以(yi)(yi)上五倍以(yi)(yi)下的(de)罰款;沒有違(wei)法所得的(de),可(ke)以(yi)(yi)處(chu)五萬(wan)元以(yi)(yi)下的(de)罰款。
“勞(lao)(lao)(lao)務(wu)(wu)派(pai)(pai)遣(qian)(qian)單(dan)位、用工單(dan)位違反本(ben)法規定的,由勞(lao)(lao)(lao)動行政部(bu)門責令改(gai)正;情節嚴重的,以(yi)每人五千(qian)元(yuan)以(yi)上一(yi)萬元(yuan)以(yi)下的標準處以(yi)罰款(kuan),對勞(lao)(lao)(lao)務(wu)(wu)派(pai)(pai)遣(qian)(qian)單(dan)位,撤銷(xiao)其經營勞(lao)(lao)(lao)務(wu)(wu)派(pai)(pai)遣(qian)(qian)業務(wu)(wu)的行政許可;給(gei)被派(pai)(pai)遣(qian)(qian)勞(lao)(lao)(lao)動者造成損害(hai)的,勞(lao)(lao)(lao)務(wu)(wu)派(pai)(pai)遣(qian)(qian)單(dan)位與用工單(dan)位承擔連(lian)帶賠償責任。”
本(ben)修(xiu)正(zheng)案(an)自 年 月 日起施行。
本修正(zheng)案開始施行(xing)時用(yong)工(gong)單(dan)位(wei)(wei)正(zheng)在使用(yong)被派遣勞(lao)動者的,用(yong)工(gong)單(dan)位(wei)(wei)、勞(lao)務(wu)派遣單(dan)位(wei)(wei)應當根據本修正(zheng)案進行(xing)調整;本修正(zheng)案施行(xing)前經營(ying)勞(lao)務(wu)派遣業務(wu)的單(dan)位(wei)(wei),依法(fa)辦(ban)理行(xing)政許(xu)可(ke)和(he)公司(si)變(bian)更登記后,方可(ke)繼續(xu)經營(ying)勞(lao)務(wu)派遣業務(wu)。具體(ti)辦(ban)法(fa)由國務(wu)院另行(xing)規(gui)定。

一(yi)、修改(gai)勞動合同法的必(bi)要性和草案(an)起(qi)草過程
我(wo)國(guo)現(xian)行勞動(dong)(dong)(dong)合(he)同(tong)法(fa)是2007年(nian)(nian)十(shi)屆全國(guo)人大(da)常委會第二十(shi)八次會議通(tong)過的(de)。該(gai)法(fa)的(de)頒布實施,對(dui)于促(cu)進勞動(dong)(dong)(dong)力資源的(de)市(shi)場配置、規范(fan)勞動(dong)(dong)(dong)關系、完善勞動(dong)(dong)(dong)合(he)同(tong)制度、明(ming)確勞動(dong)(dong)(dong)合(he)同(tong)雙方當事人的(de)權(quan)利義務、保(bao)護(hu)勞動(dong)(dong)(dong)者(zhe)的(de)合(he)法(fa)權(quan)益發(fa)揮了(le)重要作(zuo)用。尤其是在2008年(nian)(nian)以來(lai)應對(dui)國(guo)際金融危機的(de)過程中(zhong),勞動(dong)(dong)(dong)合(he)同(tong)法(fa)對(dui)于維護(hu)企業職工隊伍和社會和諧穩定,引導企業與職工和衷共(gong)濟、共(gong)克難關起到了(le)積極作(zuo)用。
勞(lao)(lao)(lao)務(wu)(wu)派(pai)(pai)遣(qian)是(shi)勞(lao)(lao)(lao)動(dong)(dong)合同(tong)(tong)法(fa)(fa)規(gui)范(fan)(fan)的(de)(de)一(yi)項重(zhong)(zhong)要(yao)(yao)內容(rong),也(ye)是(shi)勞(lao)(lao)(lao)動(dong)(dong)合同(tong)(tong)法(fa)(fa)實(shi)施中(zhong)遇到的(de)(de)一(yi)個重(zhong)(zhong)大(da)(da)(da)(da)問(wen)(wen)題(ti)(ti)(ti)。勞(lao)(lao)(lao)動(dong)(dong)合同(tong)(tong)法(fa)(fa)頒布(bu)實(shi)施后,出現了勞(lao)(lao)(lao)務(wu)(wu)派(pai)(pai)遣(qian)單(dan)位(wei)(wei)數量(liang)(liang)大(da)(da)(da)(da)幅增加、勞(lao)(lao)(lao)務(wu)(wu)派(pai)(pai)遣(qian)用(yong)工(gong)(gong)(gong)(gong)(gong)規(gui)模迅速擴大(da)(da)(da)(da)的(de)(de)情況。勞(lao)(lao)(lao)務(wu)(wu)派(pai)(pai)遣(qian)用(yong)工(gong)(gong)(gong)(gong)(gong)存在的(de)(de)突(tu)(tu)出問(wen)(wen)題(ti)(ti)(ti)主(zhu)要(yao)(yao)有(you):一(yi)是(shi)勞(lao)(lao)(lao)務(wu)(wu)派(pai)(pai)遣(qian)單(dan)位(wei)(wei)過多過濫,經營不(bu)(bu)規(gui)范(fan)(fan);二是(shi)許多用(yong)工(gong)(gong)(gong)(gong)(gong)單(dan)位(wei)(wei)長期大(da)(da)(da)(da)量(liang)(liang)使用(yong)被派(pai)(pai)遣(qian)勞(lao)(lao)(lao)動(dong)(dong)者,有(you)的(de)(de)用(yong)工(gong)(gong)(gong)(gong)(gong)單(dan)位(wei)(wei)甚至把勞(lao)(lao)(lao)務(wu)(wu)派(pai)(pai)遣(qian)作(zuo)(zuo)為用(yong)工(gong)(gong)(gong)(gong)(gong)主(zhu)渠(qu)道;三是(shi)被派(pai)(pai)遣(qian)勞(lao)(lao)(lao)動(dong)(dong)者的(de)(de)合法(fa)(fa)權(quan)益得(de)不(bu)(bu)到有(you)效保(bao)(bao)障,同(tong)(tong)工(gong)(gong)(gong)(gong)(gong)不(bu)(bu)同(tong)(tong)酬(chou)、不(bu)(bu)同(tong)(tong)保(bao)(bao)障待遇的(de)(de)問(wen)(wen)題(ti)(ti)(ti)比(bi)較(jiao)(jiao)突(tu)(tu)出,參與企業民主(zhu)管理和參加工(gong)(gong)(gong)(gong)(gong)會組織等權(quan)利得(de)不(bu)(bu)到很好(hao)落實(shi),一(yi)些被派(pai)(pai)遣(qian)勞(lao)(lao)(lao)動(dong)(dong)者長期沒有(you)歸屬感,心(xin)理落差較(jiao)(jiao)大(da)(da)(da)(da)。勞(lao)(lao)(lao)務(wu)(wu)派(pai)(pai)遣(qian)用(yong)工(gong)(gong)(gong)(gong)(gong)制度(du)的(de)(de)濫用(yong)不(bu)(bu)僅(jin)損害了勞(lao)(lao)(lao)動(dong)(dong)者的(de)(de)合法(fa)(fa)權(quan)益,也(ye)對常規(gui)的(de)(de)用(yong)工(gong)(gong)(gong)(gong)(gong)方式和勞(lao)(lao)(lao)動(dong)(dong)合同(tong)(tong)制度(du)造成較(jiao)(jiao)大(da)(da)(da)(da)沖(chong)擊。這(zhe)(zhe)些問(wen)(wen)題(ti)(ti)(ti)如不(bu)(bu)盡快解決(jue),必然給和諧勞(lao)(lao)(lao)動(dong)(dong)關系和社會穩定帶來(lai)負(fu)面影響。全(quan)國(guo)人(ren)大(da)(da)(da)(da)常委會在2008年和2011年對勞(lao)(lao)(lao)動(dong)(dong)合同(tong)(tong)法(fa)(fa)進行的(de)(de)執(zhi)法(fa)(fa)檢查(cha)中(zhong)都明確要(yao)(yao)求(qiu)(qiu),要(yao)(yao)嚴格規(gui)范(fan)(fan)勞(lao)(lao)(lao)務(wu)(wu)派(pai)(pai)遣(qian)用(yong)工(gong)(gong)(gong)(gong)(gong),保(bao)(bao)障被派(pai)(pai)遣(qian)勞(lao)(lao)(lao)動(dong)(dong)者的(de)(de)合法(fa)(fa)權(quan)益。全(quan)國(guo)人(ren)大(da)(da)(da)(da)常委會領(ling)導同(tong)(tong)志(zhi)對此也(ye)高度(du)重(zhong)(zhong)視,多次(ci)作(zuo)(zuo)出重(zhong)(zhong)要(yao)(yao)指示,要(yao)(yao)求(qiu)(qiu)從(cong)維護工(gong)(gong)(gong)(gong)(gong)人(ren)階級主(zhu)體地位(wei)(wei)、鞏固黨的(de)(de)執(zhi)政基(ji)礎(chu)的(de)(de)高度(du)來(lai)認識(shi)這(zhe)(zhe)個問(wen)(wen)題(ti)(ti)(ti),加強調查(cha)研究,盡快從(cong)法(fa)(fa)律(lv)上嚴格規(gui)范(fan)(fan)勞(lao)(lao)(lao)務(wu)(wu)派(pai)(pai)遣(qian)用(yong)工(gong)(gong)(gong)(gong)(gong)。
按(an)照常委(wei)(wei)會(hui)的要求,由全(quan)國(guo)人大常委(wei)(wei)會(hui)法(fa)(fa)制工(gong)作委(wei)(wei)員會(hui)牽(qian)頭,會(hui)同全(quan)國(guo)人大內務(wu)(wu)司法(fa)(fa)委(wei)(wei)員會(hui)、財政(zheng)經(jing)濟委(wei)(wei)員會(hui)開展了(le)勞(lao)務(wu)(wu)派(pai)(pai)(pai)遣(qian)用(yong)(yong)(yong)工(gong)情(qing)況(kuang)(kuang)的調(diao)(diao)研。調(diao)(diao)研組先(xian)后赴廣(guang)東、福(fu)建、北京、安徽等(deng)地深入企(qi)事(shi)業單(dan)位了(le)解情(qing)況(kuang)(kuang),聽取意見;召開中(zhong)(zhong)央(yang)有(you)關部門、部分(fen)(fen)勞(lao)動用(yong)(yong)(yong)工(gong)單(dan)位和(he)勞(lao)務(wu)(wu)派(pai)(pai)(pai)遣(qian)單(dan)位參(can)加的座談會(hui),充分(fen)(fen)聽取各方(fang)面對修改完善(shan)勞(lao)務(wu)(wu)派(pai)(pai)(pai)遣(qian)法(fa)(fa)律規定(ding)的意見建議;到(dao)使(shi)用(yong)(yong)(yong)被(bei)(bei)派(pai)(pai)(pai)遣(qian)勞(lao)動者較多的部分(fen)(fen)中(zhong)(zhong)央(yang)企(qi)業調(diao)(diao)研勞(lao)務(wu)(wu)派(pai)(pai)(pai)遣(qian)用(yong)(yong)(yong)工(gong)情(qing)況(kuang)(kuang),和(he)在京部分(fen)(fen)被(bei)(bei)派(pai)(pai)(pai)遣(qian)勞(lao)動者座談,深入企(qi)業生產一線了(le)解被(bei)(bei)派(pai)(pai)(pai)遣(qian)勞(lao)動者在工(gong)作生活中(zhong)(zhong)面臨的實際情(qing)況(kuang)(kuang)。
根(gen)據調研了(le)解到的(de)情況,全國人(ren)大(da)常(chang)(chang)委(wei)會(hui)法(fa)(fa)制工(gong)作委(wei)員(yuan)會(hui)、全國人(ren)大(da)內務(wu)司法(fa)(fa)委(wei)員(yuan)會(hui)和(he)財政經濟委(wei)員(yuan)會(hui)在(zai)分(fen)別與中央(yang)有(you)關部門(men)反復溝通(tong)協調的(de)基礎上(shang)明確(que)了(le)這次(ci)(ci)修法(fa)(fa)的(de)原(yuan)則和(he)重(zhong)點:一(yi)是(shi)嚴格規范勞(lao)(lao)(lao)務(wu)派(pai)遣(qian)用(yong)工(gong),不(bu)能把勞(lao)(lao)(lao)務(wu)派(pai)遣(qian)變成(cheng)用(yong)工(gong)主(zhu)渠道;二是(shi)維護工(gong)人(ren)階級主(zhu)體(ti)地位(wei),保障被派(pai)遣(qian)勞(lao)(lao)(lao)動者實(shi)現(xian)同(tong)工(gong)同(tong)酬等權(quan)利;三是(shi)加強對勞(lao)(lao)(lao)務(wu)派(pai)遣(qian)單位(wei)的(de)管理,強化勞(lao)(lao)(lao)動行政部門(men)的(de)監督職責;四是(shi)規范勞(lao)(lao)(lao)務(wu)派(pai)遣(qian)既要積極又(you)要穩妥,妥善處理好修法(fa)(fa)前(qian)后法(fa)(fa)律實(shi)施的(de)銜接問題,實(shi)現(xian)平穩過渡。按照(zhao)上(shang)述要求,由全國人(ren)大(da)常(chang)(chang)委(wei)會(hui)法(fa)(fa)制工(gong)作委(wei)員(yuan)會(hui)牽頭起草(cao)了(le)勞(lao)(lao)(lao)動合同(tong)法(fa)(fa)修正(zheng)案(an)草(cao)案(an),并經財政經濟委(wei)員(yuan)會(hui)第67次(ci)(ci)全體(ti)會(hui)議審(shen)議通(tong)過,提請本次(ci)(ci)常(chang)(chang)委(wei)會(hui)會(hui)議審(shen)議。
二、修改的主要(yao)內容
(一)嚴格限制(zhi)勞務派遣用(yong)工(gong)崗位范圍
現行勞(lao)動(dong)合(he)同(tong)法第六十(shi)六條規定(ding)(ding),勞(lao)務(wu)(wu)(wu)派(pai)遣(qian)(qian)一般在(zai)臨(lin)時(shi)性(xing)(xing)(xing)、輔助性(xing)(xing)(xing)或者(zhe)(zhe)替代性(xing)(xing)(xing)的工(gong)(gong)(gong)作(zuo)(zuo)(zuo)崗(gang)(gang)(gang)(gang)位(wei)(wei)(wei)(wei)上(shang)實施(shi)。勞(lao)動(dong)合(he)同(tong)法實施(shi)以(yi)來,勞(lao)務(wu)(wu)(wu)派(pai)遣(qian)(qian)用(yong)(yong)(yong)工(gong)(gong)(gong)數量(liang)快速增(zeng)長,部分(fen)企(qi)業(ye)突(tu)破 “三(san)性(xing)(xing)(xing)”崗(gang)(gang)(gang)(gang)位(wei)(wei)(wei)(wei)范圍,在(zai)主營業(ye)務(wu)(wu)(wu)崗(gang)(gang)(gang)(gang)位(wei)(wei)(wei)(wei)和(he)一般性(xing)(xing)(xing)工(gong)(gong)(gong)作(zuo)(zuo)(zuo)崗(gang)(gang)(gang)(gang)位(wei)(wei)(wei)(wei)長期(qi)大(da)量(liang)使用(yong)(yong)(yong)被(bei)派(pai)遣(qian)(qian)勞(lao)動(dong)者(zhe)(zhe)。為(wei)嚴格限制勞(lao)務(wu)(wu)(wu)派(pai)遣(qian)(qian)用(yong)(yong)(yong)工(gong)(gong)(gong),草案規定(ding)(ding)勞(lao)務(wu)(wu)(wu)派(pai)遣(qian)(qian)“只能”在(zai)“三(san)性(xing)(xing)(xing)”崗(gang)(gang)(gang)(gang)位(wei)(wei)(wei)(wei)上(shang)實施(shi),并對“三(san)性(xing)(xing)(xing)”崗(gang)(gang)(gang)(gang)位(wei)(wei)(wei)(wei)的具體含義作(zuo)(zuo)(zuo)了進一步界定(ding)(ding):臨(lin)時(shi)性(xing)(xing)(xing)是(shi)指(zhi)用(yong)(yong)(yong)工(gong)(gong)(gong)單(dan)位(wei)(wei)(wei)(wei)的工(gong)(gong)(gong)作(zuo)(zuo)(zuo)崗(gang)(gang)(gang)(gang)位(wei)(wei)(wei)(wei)存續時(shi)間不超過六個月;輔助性(xing)(xing)(xing)是(shi)指(zhi)用(yong)(yong)(yong)工(gong)(gong)(gong)單(dan)位(wei)(wei)(wei)(wei)的工(gong)(gong)(gong)作(zuo)(zuo)(zuo)崗(gang)(gang)(gang)(gang)位(wei)(wei)(wei)(wei)為(wei)主營業(ye)務(wu)(wu)(wu)崗(gang)(gang)(gang)(gang)位(wei)(wei)(wei)(wei)提供服務(wu)(wu)(wu);替代性(xing)(xing)(xing)是(shi)指(zhi)用(yong)(yong)(yong)工(gong)(gong)(gong)單(dan)位(wei)(wei)(wei)(wei)的職(zhi)工(gong)(gong)(gong)因(yin)脫產(chan)學習、休假等原因(yin)在(zai)該工(gong)(gong)(gong)作(zuo)(zuo)(zuo)崗(gang)(gang)(gang)(gang)位(wei)(wei)(wei)(wei)上(shang)無法工(gong)(gong)(gong)作(zuo)(zuo)(zuo)的一定(ding)(ding)期(qi)間內,可以(yi)由被(bei)派(pai)遣(qian)(qian)勞(lao)動(dong)者(zhe)(zhe)替代工(gong)(gong)(gong)作(zuo)(zuo)(zuo)。
(二)對設立(li)勞(lao)務(wu)派遣單位實(shi)行(xing)行(xing)政許可
現(xian)行勞(lao)(lao)動合(he)同(tong)法(fa)(fa)第五十七條(tiao)規(gui)定,勞(lao)(lao)務(wu)派遣單(dan)位應當(dang)(dang)依(yi)照公司法(fa)(fa)的(de)(de)有關規(gui)定設立,注冊(ce)資(zi)本(ben)不(bu)得少(shao)于五十萬(wan)(wan)元。勞(lao)(lao)動合(he)同(tong)法(fa)(fa)實施以來,從事勞(lao)(lao)務(wu)派遣的(de)(de)單(dan)位增長較快。一(yi)些勞(lao)(lao)務(wu)派遣單(dan)位經營(ying)不(bu)規(gui)范,規(gui)章制度不(bu)健全,侵害(hai)被(bei)派遣勞(lao)(lao)動者(zhe)的(de)(de)合(he)法(fa)(fa)權(quan)益。由于勞(lao)(lao)務(wu)派遣單(dan)位準入門(men)(men)檻低(di),承(cheng)擔責任(ren)能力差,被(bei)派遣勞(lao)(lao)動者(zhe)的(de)(de)合(he)法(fa)(fa)權(quan)益受到(dao)侵害(hai)后(hou),難以獲得有效賠償。為(wei)促使勞(lao)(lao)務(wu)派遣單(dan)位依(yi)法(fa)(fa)經營(ying),草(cao)案(an)規(gui)定,經營(ying)勞(lao)(lao)務(wu)派遣業(ye)務(wu)應當(dang)(dang)向勞(lao)(lao)動行政部門(men)(men)依(yi)法(fa)(fa)辦理行政許(xu)可,并對取得許(xu)可的(de)(de)條(tiao)件(jian)作了(le)具體規(gui)定,包(bao)括將注冊(ce)資(zi)本(ben)要求由不(bu)得少(shao)于人民幣五十萬(wan)(wan)元提(ti)高到(dao)不(bu)得少(shao)于人民幣一(yi)百萬(wan)(wan)元、勞(lao)(lao)務(wu)派遣單(dan)位應當(dang)(dang)有符合(he)法(fa)(fa)律規(gui)定的(de)(de)勞(lao)(lao)務(wu)派遣管理制度等。
(三)切實(shi)維護被派遣勞(lao)動(dong)者享有與用工(gong)單(dan)位的(de)勞(lao)動(dong)者同(tong)工(gong)同(tong)酬的(de)權(quan)利
同(tong)(tong)(tong)工(gong)同(tong)(tong)(tong)酬(chou)(chou)是勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong)(tong)法規定(ding)(ding)的(de)(de)(de)(de)一項重要原則。現行(xing)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong)(tong)法第六十三條規定(ding)(ding),被(bei)派(pai)(pai)(pai)(pai)遣(qian)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)(zhe)(zhe)享有與用工(gong)單(dan)位(wei)(wei)(wei)(wei)的(de)(de)(de)(de)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)(zhe)(zhe)同(tong)(tong)(tong)工(gong)同(tong)(tong)(tong)酬(chou)(chou)的(de)(de)(de)(de)權利。用工(gong)單(dan)位(wei)(wei)(wei)(wei)無(wu)同(tong)(tong)(tong)類崗(gang)位(wei)(wei)(wei)(wei)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)(zhe)(zhe)的(de)(de)(de)(de),參照用工(gong)單(dan)位(wei)(wei)(wei)(wei)所在地相(xiang)同(tong)(tong)(tong)或(huo)者(zhe)(zhe)(zhe)相(xiang)近崗(gang)位(wei)(wei)(wei)(wei)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)(zhe)(zhe)的(de)(de)(de)(de)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)報酬(chou)(chou)確定(ding)(ding)。勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong)(tong)法實施以來,多(duo)數企業(ye)對本(ben)(ben)單(dan)位(wei)(wei)(wei)(wei)的(de)(de)(de)(de)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong)(tong)制職(zhi)工(gong)逐步做到了同(tong)(tong)(tong)工(gong)同(tong)(tong)(tong)酬(chou)(chou),但對被(bei)派(pai)(pai)(pai)(pai)遣(qian)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)(zhe)(zhe)與本(ben)(ben)單(dan)位(wei)(wei)(wei)(wei)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong)(tong)制職(zhi)工(gong)實行(xing)不同(tong)(tong)(tong)的(de)(de)(de)(de)工(gong)資福(fu)利標準(zhun)和分配辦法,有的(de)(de)(de)(de)被(bei)派(pai)(pai)(pai)(pai)遣(qian)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)(zhe)(zhe)的(de)(de)(de)(de)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)報酬(chou)(chou)、社(she)會保險、企業(ye)福(fu)利等(deng)與用工(gong)單(dan)位(wei)(wei)(wei)(wei)的(de)(de)(de)(de)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong)(tong)制職(zhi)工(gong)相(xiang)比差(cha)距(ju)較(jiao)大。為落實被(bei)派(pai)(pai)(pai)(pai)遣(qian)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)(zhe)(zhe)同(tong)(tong)(tong)工(gong)同(tong)(tong)(tong)酬(chou)(chou)的(de)(de)(de)(de)權利,草案增加規定(ding)(ding)勞(lao)(lao)(lao)(lao)務(wu)派(pai)(pai)(pai)(pai)遣(qian)單(dan)位(wei)(wei)(wei)(wei)與被(bei)派(pai)(pai)(pai)(pai)遣(qian)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)(zhe)(zhe)訂(ding)立的(de)(de)(de)(de)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong)(tong)以及與用工(gong)單(dan)位(wei)(wei)(wei)(wei)訂(ding)立的(de)(de)(de)(de)勞(lao)(lao)(lao)(lao)務(wu)派(pai)(pai)(pai)(pai)遣(qian)協議,載(zai)明或(huo)者(zhe)(zhe)(zhe)約定(ding)(ding)的(de)(de)(de)(de)向被(bei)派(pai)(pai)(pai)(pai)遣(qian)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)(zhe)(zhe)支付的(de)(de)(de)(de)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)報酬(chou)(chou)應當(dang)符合(he)(he)同(tong)(tong)(tong)工(gong)同(tong)(tong)(tong)酬(chou)(chou)的(de)(de)(de)(de)規定(ding)(ding)。
(四)增加對相應違法行為的處罰(fa)
根據上述修(xiu)改內容(rong)以(yi)(yi)及進一步嚴格規(gui)范勞(lao)(lao)務派遣(qian)(qian)用工的要求,草案對(dui)勞(lao)(lao)動合同(tong)法法律責任部分作了相應修(xiu)改:一是(shi)(shi)增加規(gui)定,對(dui)未經(jing)許可擅自經(jing)營勞(lao)(lao)務派遣(qian)(qian)業務的,由勞(lao)(lao)動行(xing)政部門(men)依(yi)法予以(yi)(yi)取締,沒收(shou)違(wei)法所得(de),并處(chu)以(yi)(yi)罰款(kuan)。二是(shi)(shi)進一步明確(que)規(gui)定勞(lao)(lao)務派遣(qian)(qian)單位、用工單位違(wei)反勞(lao)(lao)動合同(tong)法規(gui)定的,處(chu)以(yi)(yi)罰款(kuan),并適當提高了罰款(kuan)額度(du);對(dui)勞(lao)(lao)務派遣(qian)(qian)單位并可吊銷其經(jing)營勞(lao)(lao)務派遣(qian)(qian)業務的行(xing)政許可。
(五)處(chu)理好(hao)法律實施的銜接(jie)
為(wei)實現修法前后勞務派(pai)(pai)遣(qian)(qian)用工(gong)制度的(de)平(ping)穩過渡,草案(an)(an)規定,本(ben)修正案(an)(an)開始施行(xing)時用工(gong)單位(wei)(wei)正在使(shi)用被(bei)派(pai)(pai)遣(qian)(qian)勞動者的(de),用工(gong)單位(wei)(wei)、勞務派(pai)(pai)遣(qian)(qian)單位(wei)(wei)應(ying)當根據(ju)本(ben)修正案(an)(an)進行(xing)調(diao)整;本(ben)修正案(an)(an)施行(xing)前經營勞務派(pai)(pai)遣(qian)(qian)業務的(de)單位(wei)(wei),依法辦(ban)理行(xing)政許可(ke)和公司變更登記(ji)后,方(fang)可(ke)繼(ji)續經營勞務派(pai)(pai)遣(qian)(qian)業務。具體辦(ban)法由國務院(yuan)另(ling)行(xing)規定。
對于(yu)在修正案施行前依(yi)法(fa)(fa)(fa)向工商行政(zheng)管理(li)部門辦理(li)登記經營(ying)勞(lao)務派(pai)遣業務的(de)單位,自修正案施行之(zhi)日起未依(yi)法(fa)(fa)(fa)辦理(li)許可或者申請許可未獲批準的(de),應當按照勞(lao)動合(he)同(tong)法(fa)(fa)(fa)、合(he)同(tong)法(fa)(fa)(fa)、公司(si)法(fa)(fa)(fa)等(deng)有關法(fa)(fa)(fa)律、法(fa)(fa)(fa)規規定(ding),與用工單位、工會組(zu)織進行協商,對其尚未履行完畢的(de)合(he)同(tong)、勞(lao)務派(pai)遣協議作出妥善(shan)處理(li)。勞(lao)動行政(zheng)部門、工商行政(zheng)管理(li)部門應當加強(qiang)監督檢查,切實(shi)保障被派(pai)遣勞(lao)動者的(de)合(he)法(fa)(fa)(fa)權(quan)益。
