黨的二十屆三中全會通過的《中共中央關于進(jin)一步全面(mian)深(shen)化改革(ge)、推(tui)進(jin)中國式現代化的決定》強調“深(shen)入(ru)推(tui)進(jin)依法(fa)(fa)(fa)行(xing)(xing)政(zheng)(zheng)”,對健(jian)全政(zheng)(zheng)府(fu)機構職(zhi)能體(ti)系、深(shen)化行(xing)(xing)政(zheng)(zheng)執(zhi)法(fa)(fa)(fa)體(ti)制(zhi)改革(ge)、完(wan)善政(zheng)(zheng)府(fu)管理(li)體(ti)制(zhi)機制(zhi)等作出重要(yao)部(bu)署,提出新(xin)的要(yao)求。要(yao)堅持以習(xi)(xi)(xi)近(jin)平新(xin)時代中國特色(se)社會主(zhu)義思想(xiang)為(wei)指導,深(shen)入(ru)學(xue)(xue)習(xi)(xi)(xi)貫徹(che)習(xi)(xi)(xi)近(jin)平法(fa)(fa)(fa)治思想(xiang),緊緊圍繞(rao)推(tui)進(jin)中國式現代化,全面(mian)建設職(zhi)能科學(xue)(xue)、權(quan)責法(fa)(fa)(fa)定、執(zhi)法(fa)(fa)(fa)嚴(yan)明、公(gong)開公(gong)正、智能高效、廉潔誠信、人民滿(man)意的法(fa)(fa)(fa)治政(zheng)(zheng)府(fu),不(bu)斷提升依法(fa)(fa)(fa)行(xing)(xing)政(zheng)(zheng)水平。
一、健全政府機構職能體(ti)系,提升依(yi)法決策和政務服(fu)務水平
深(shen)入(ru)推進(jin)依法(fa)行政,必(bi)須用(yong)法(fa)治(zhi)給(gei)行政權(quan)力(li)定規(gui)矩(ju)、劃界限,確(que)保政府職(zhi)權(quan)法(fa)定、依法(fa)履職(zhi)。
推進(jin)政(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)(fu)機(ji)(ji)(ji)構(gou)(gou)(gou)、職(zhi)(zhi)能(neng)(neng)(neng)、權(quan)限、程(cheng)序、責任法(fa)(fa)定化(hua)(hua)。機(ji)(ji)(ji)構(gou)(gou)(gou)職(zhi)(zhi)能(neng)(neng)(neng)法(fa)(fa)定化(hua)(hua)是加(jia)(jia)(jia)快(kuai)建設(she)法(fa)(fa)治政(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)(fu)、深入推進(jin)依法(fa)(fa)行政(zheng)(zheng)(zheng)(zheng)(zheng)的重要內容。黨的二十(shi)大和(he)二十(shi)屆二中(zhong)、三(san)中(zhong)全(quan)會對(dui)推進(jin)政(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)(fu)機(ji)(ji)(ji)構(gou)(gou)(gou)、職(zhi)(zhi)能(neng)(neng)(neng)、權(quan)限、程(cheng)序、責任法(fa)(fa)定化(hua)(hua)作出部署(shu)。要進(jin)一步完善相關(guan)黨內法(fa)(fa)規和(he)國(guo)家法(fa)(fa)律法(fa)(fa)規,依法(fa)(fa)依規設(she)立(li)機(ji)(ji)(ji)構(gou)(gou)(gou)、配(pei)置職(zhi)(zhi)能(neng)(neng)(neng)、明確權(quan)限和(he)責任、規范(fan)運行程(cheng)序,推動(dong)改革成果制度化(hua)(hua)法(fa)(fa)定化(hua)(hua)。堅(jian)(jian)持優化(hua)(hua)政(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)(fu)組織結(jie)構(gou)(gou)(gou)與(yu)促進(jin)政(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)(fu)職(zhi)(zhi)能(neng)(neng)(neng)轉變、理順部門職(zhi)(zhi)責關(guan)系統籌結(jie)合,使機(ji)(ji)(ji)構(gou)(gou)(gou)設(she)置更(geng)加(jia)(jia)(jia)科學(xue)、職(zhi)(zhi)能(neng)(neng)(neng)更(geng)加(jia)(jia)(jia)優化(hua)(hua)、權(quan)責更(geng)加(jia)(jia)(jia)匹配(pei)。堅(jian)(jian)持法(fa)(fa)定職(zhi)(zhi)責必(bi)須為(wei)、法(fa)(fa)無授權(quan)不可(ke)為(wei),推進(jin)政(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)(fu)機(ji)(ji)(ji)構(gou)(gou)(gou)職(zhi)(zhi)能(neng)(neng)(neng)優化(hua)(hua)協(xie)同高效(xiao),形成邊界清晰(xi)、分工合理、權(quan)責一致、運行高效(xiao)、法(fa)(fa)治保障(zhang)的政(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)(fu)機(ji)(ji)(ji)構(gou)(gou)(gou)職(zhi)(zhi)能(neng)(neng)(neng)體系。
完善(shan)重大決(jue)(jue)(jue)策(ce)、規(gui)(gui)范(fan)性(xing)(xing)(xing)(xing)文(wen)件(jian)(jian)合(he)(he)法(fa)(fa)(fa)(fa)性(xing)(xing)(xing)(xing)審(shen)(shen)查(cha)(cha)機制。堅持科學決(jue)(jue)(jue)策(ce)、民主決(jue)(jue)(jue)策(ce)、依法(fa)(fa)(fa)(fa)決(jue)(jue)(jue)策(ce),對于加快建設(she)法(fa)(fa)(fa)(fa)治政(zheng)府、深入推進依法(fa)(fa)(fa)(fa)行(xing)政(zheng)至關(guan)重要(yao)(yao)(yao)。要(yao)(yao)(yao)完善(shan)重大決(jue)(jue)(jue)策(ce)合(he)(he)法(fa)(fa)(fa)(fa)性(xing)(xing)(xing)(xing)審(shen)(shen)查(cha)(cha)機制,未經合(he)(he)法(fa)(fa)(fa)(fa)性(xing)(xing)(xing)(xing)審(shen)(shen)查(cha)(cha)或(huo)經審(shen)(shen)查(cha)(cha)不合(he)(he)法(fa)(fa)(fa)(fa)的,不得(de)提交討論。行(xing)政(zheng)機關(guan)主要(yao)(yao)(yao)負責(ze)(ze)人作出(chu)重大決(jue)(jue)(jue)策(ce)前,應當聽取合(he)(he)法(fa)(fa)(fa)(fa)性(xing)(xing)(xing)(xing)審(shen)(shen)查(cha)(cha)機構的意見,注重聽取法(fa)(fa)(fa)(fa)律顧問、公(gong)職律師或(huo)者有(you)關(guan)專家(jia)的意見。嚴格落實重大決(jue)(jue)(jue)策(ce)終身責(ze)(ze)任(ren)追(zhui)究制度和(he)責(ze)(ze)任(ren)倒(dao)查(cha)(cha)機制。要(yao)(yao)(yao)進一步明確(que)規(gui)(gui)范(fan)性(xing)(xing)(xing)(xing)文(wen)件(jian)(jian)合(he)(he)法(fa)(fa)(fa)(fa)性(xing)(xing)(xing)(xing)審(shen)(shen)查(cha)(cha)范(fan)圍(wei),規(gui)(gui)范(fan)審(shen)(shen)查(cha)(cha)程序,強(qiang)化審(shen)(shen)查(cha)(cha)責(ze)(ze)任(ren),健全程序完備、權責(ze)(ze)一致、相互銜接、運行(xing)高效的合(he)(he)法(fa)(fa)(fa)(fa)性(xing)(xing)(xing)(xing)審(shen)(shen)查(cha)(cha)機制。凡涉(she)及公(gong)民、法(fa)(fa)(fa)(fa)人或(huo)者其他(ta)組織權利和(he)義務的規(gui)(gui)范(fan)性(xing)(xing)(xing)(xing)文(wen)件(jian)(jian)均應經過合(he)(he)法(fa)(fa)(fa)(fa)性(xing)(xing)(xing)(xing)審(shen)(shen)查(cha)(cha)。未經合(he)(he)法(fa)(fa)(fa)(fa)性(xing)(xing)(xing)(xing)審(shen)(shen)查(cha)(cha)或(huo)者不采(cai)納合(he)(he)法(fa)(fa)(fa)(fa)性(xing)(xing)(xing)(xing)審(shen)(shen)查(cha)(cha)意見導致規(gui)(gui)范(fan)性(xing)(xing)(xing)(xing)文(wen)件(jian)(jian)違(wei)法(fa)(fa)(fa)(fa),造(zao)成嚴重后(hou)果(guo)的,依紀(ji)依法(fa)(fa)(fa)(fa)追(zhui)究有(you)關(guan)責(ze)(ze)任(ren)人員(yuan)的責(ze)(ze)任(ren)。要(yao)(yao)(yao)加強(qiang)政(zheng)府立法(fa)(fa)(fa)(fa)審(shen)(shen)查(cha)(cha),防止(zhi)部門利益和(he)本位主義,提高政(zheng)府立法(fa)(fa)(fa)(fa)質(zhi)量。

二、深化行政(zheng)執(zhi)法(fa)體制(zhi)改(gai)革,促進嚴格公正文明規(gui)范執(zhi)法(fa)
行政執法(fa)(fa)是政府實(shi)施法(fa)(fa)律法(fa)(fa)規、履行法(fa)(fa)定(ding)職能、管(guan)理(li)經(jing)濟社會事務的重要方(fang)式。要完(wan)善權責(ze)清(qing)晰、運轉順暢、保障有力、廉(lian)潔高效的行政執法(fa)(fa)體(ti)制(zhi)機制(zhi),大力提高執法(fa)(fa)執行力和公信(xin)力。
完善行(xing)(xing)(xing)政(zheng)(zheng)處罰等(deng)領域行(xing)(xing)(xing)政(zheng)(zheng)裁量(liang)(liang)權基準(zhun)制度(du)。規(gui)(gui)(gui)范行(xing)(xing)(xing)政(zheng)(zheng)裁量(liang)(liang)權基準(zhun)制定和管(guan)理(li),對保(bao)障法(fa)(fa)(fa)律(lv)、法(fa)(fa)(fa)規(gui)(gui)(gui)、規(gui)(gui)(gui)章有效實(shi)施,規(gui)(gui)(gui)范行(xing)(xing)(xing)政(zheng)(zheng)執(zhi)法(fa)(fa)(fa)行(xing)(xing)(xing)為(wei)(wei),維護社(she)會公(gong)(gong)平正義(yi)具有重要(yao)意(yi)義(yi)。行(xing)(xing)(xing)政(zheng)(zheng)裁量(liang)(liang)權基準(zhun)是具體執(zhi)法(fa)(fa)(fa)尺(chi)度(du)和標準(zhun)。行(xing)(xing)(xing)政(zheng)(zheng)機關(guan)應(ying)結合(he)本(ben)地區本(ben)部門行(xing)(xing)(xing)政(zheng)(zheng)管(guan)理(li)實(shi)際(ji),按照裁量(liang)(liang)涉及(ji)(ji)的(de)(de)(de)(de)不同事實(shi)和情(qing)節,對法(fa)(fa)(fa)律(lv)、法(fa)(fa)(fa)規(gui)(gui)(gui)、規(gui)(gui)(gui)章中的(de)(de)(de)(de)原則(ze)性規(gui)(gui)(gui)定或者具有一(yi)定彈性的(de)(de)(de)(de)執(zhi)法(fa)(fa)(fa)權限、裁量(liang)(liang)幅度(du)等(deng)內容進行(xing)(xing)(xing)細化量(liang)(liang)化,以特定形式向社(she)會公(gong)(gong)布并施行(xing)(xing)(xing)。要(yao)堅(jian)持(chi)法(fa)(fa)(fa)制統一(yi),裁量(liang)(liang)權基準(zhun)的(de)(de)(de)(de)設定要(yao)符合(he)法(fa)(fa)(fa)律(lv)、法(fa)(fa)(fa)規(gui)(gui)(gui)、規(gui)(gui)(gui)章有關(guan)行(xing)(xing)(xing)政(zheng)(zheng)執(zhi)法(fa)(fa)(fa)事項、條件、程(cheng)序(xu)、種類(lei)、幅度(du)的(de)(de)(de)(de)規(gui)(gui)(gui)定。堅(jian)持(chi)程(cheng)序(xu)公(gong)(gong)正,廣泛聽取公(gong)(gong)民(min)、法(fa)(fa)(fa)人和其(qi)他組織的(de)(de)(de)(de)意(yi)見,依法(fa)(fa)(fa)保(bao)障行(xing)(xing)(xing)政(zheng)(zheng)相對人、利(li)害關(guan)系(xi)人的(de)(de)(de)(de)知情(qing)權和參與權。堅(jian)持(chi)公(gong)(gong)平合(he)理(li),綜合(he)考慮行(xing)(xing)(xing)政(zheng)(zheng)職權的(de)(de)(de)(de)種類(lei),以及(ji)(ji)行(xing)(xing)(xing)政(zheng)(zheng)執(zhi)法(fa)(fa)(fa)行(xing)(xing)(xing)為(wei)(wei)的(de)(de)(de)(de)事實(shi)、性質、情(qing)節、法(fa)(fa)(fa)律(lv)要(yao)求和本(ben)地區經濟社(she)會發展狀況(kuang)等(deng)因素,確屬必(bi)要(yao)、適當,并符合(he)社(she)會公(gong)(gong)序(xu)良(liang)俗和公(gong)(gong)眾(zhong)合(he)理(li)期待。堅(jian)持(chi)高效便民(min),避免(mian)濫用行(xing)(xing)(xing)政(zheng)(zheng)裁量(liang)(liang)權,防止執(zhi)法(fa)(fa)(fa)擾民(min)和執(zhi)法(fa)(fa)(fa)簡單粗暴“一(yi)刀切”,最(zui)大程(cheng)度(du)為(wei)(wei)經營主體和人民(min)群眾(zhong)提供便利(li)。
完(wan)善基(ji)層(ceng)(ceng)綜(zong)合(he)(he)執(zhi)(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)體制(zhi)(zhi)(zhi)(zhi)機(ji)(ji)制(zhi)(zhi)(zhi)(zhi)。基(ji)層(ceng)(ceng)執(zhi)(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)是(shi)行(xing)政(zheng)執(zhi)(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)的“最(zui)后一(yi)公里”,與廣大(da)人民(min)群眾息息相(xiang)關。近年來(lai),基(ji)層(ceng)(ceng)綜(zong)合(he)(he)執(zhi)(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)體制(zhi)(zhi)(zhi)(zhi)機(ji)(ji)制(zhi)(zhi)(zhi)(zhi)改革深入推進(jin),許(xu)多地方(fang)賦(fu)予鄉鎮(街(jie)道)執(zhi)(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)權,下沉執(zhi)(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)力量,取得明顯(xian)成效。但也存在(zai)一(yi)些執(zhi)(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)事項基(ji)層(ceng)(ceng)接不(bu)(bu)住、管不(bu)(bu)好,縣(xian)鄉兩級(ji)執(zhi)(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)協(xie)作(zuo)機(ji)(ji)制(zhi)(zhi)(zhi)(zhi)還(huan)不(bu)(bu)夠順暢等問題。完(wan)善基(ji)層(ceng)(ceng)綜(zong)合(he)(he)執(zhi)(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)體制(zhi)(zhi)(zhi)(zhi)機(ji)(ji)制(zhi)(zhi)(zhi)(zhi),要科學(xue)合(he)(he)理制(zhi)(zhi)(zhi)(zhi)定基(ji)層(ceng)(ceng)執(zhi)(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)基(ji)本權責(ze)清單(dan)和(he)配合(he)(he)權責(ze)清單(dan),穩(wen)步將基(ji)層(ceng)(ceng)管理迫切需要也能夠有(you)效承接的行(xing)政(zheng)執(zhi)(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)事項下放給基(ji)層(ceng)(ceng),將基(ji)層(ceng)(ceng)承接不(bu)(bu)了(le)的行(xing)政(zheng)執(zhi)(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)事項收回上級(ji)主(zhu)管部(bu)門。穩(wen)妥推進(jin)綜(zong)合(he)(he)行(xing)政(zheng)執(zhi)(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa),健全完(wan)善鄉鎮(街(jie)道)與縣(xian)級(ji)職能部(bu)門行(xing)政(zheng)執(zhi)(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)統籌(chou)調度和(he)協(xie)作(zuo)配合(he)(he)機(ji)(ji)制(zhi)(zhi)(zhi)(zhi),形成工(gong)作(zuo)合(he)(he)力。

深(shen)入推進依(yi)法(fa)行(xing)(xing)政(zheng)(zheng),必須推動(dong)有(you)效市場和有(you)為政(zheng)(zheng)府更好結合,堅持和完善(shan)中國特色(se)社(she)會主義行(xing)(xing)政(zheng)(zheng)體(ti)制,構(gou)建職責明確、依(yi)法(fa)行(xing)(xing)政(zheng)(zheng)的政(zheng)(zheng)府治理體(ti)系。

穩妥(tuo)推進人口小縣(xian)機(ji)(ji)構(gou)(gou)優(you)化。人口小縣(xian)是我國(guo)(guo)縣(xian)域中的一(yi)個(ge)(ge)特(te)(te)殊(shu)類型。全國(guo)(guo)人口少于15萬的縣(xian)(市(shi)、旗)有389個(ge)(ge)。這些縣(xian)人口數量較(jiao)少,經濟總(zong)量不(bu)大(da),但很(hen)多是地(di)域大(da)縣(xian)、生(sheng)態大(da)縣(xian),在(zai)鄉(xiang)村振興(xing)、生(sheng)態保護等(deng)方(fang)面發揮(hui)著不(bu)可替代的特(te)(te)殊(shu)作用。要加強(qiang)戰(zhan)略(lve)謀劃和頂(ding)層設(she)計(ji),在(zai)總(zong)結試點經驗做法、深入調研論證(zheng)基礎上,研究制(zhi)(zhi)定指(zhi)導(dao)(dao)意見,為(wei)穩妥(tuo)推進人口小縣(xian)機(ji)(ji)構(gou)(gou)優(you)化提供政(zheng)策(ce)指(zhi)引(yin)。結合人口小縣(xian)實際,著力(li)(li)從領導(dao)(dao)體制(zhi)(zhi)、機(ji)(ji)構(gou)(gou)職責、資(zi)源配置(zhi)、運行機(ji)(ji)制(zhi)(zhi)上把加強(qiang)黨的全面領導(dao)(dao)落(luo)實到(dao)各方(fang)面各環節。因地(di)制(zhi)(zhi)宜、因需制(zhi)(zhi)宜,突出主(zhu)體功(gong)能(neng),綜(zong)合設(she)置(zhi)機(ji)(ji)構(gou)(gou),確保該(gai)加強(qiang)的機(ji)(ji)構(gou)(gou)職能(neng)切(qie)實得(de)到(dao)加強(qiang),該(gai)精簡(jian)的機(ji)(ji)構(gou)(gou)切(qie)實得(de)到(dao)精簡(jian),進一(yi)步提高行政(zheng)效(xiao)(xiao)能(neng),降低(di)行政(zheng)成本。推進縣(xian)鄉(xiang)聯動改革,規范鄉(xiang)鎮(zhen)(街道(dao))機(ji)(ji)構(gou)(gou)設(she)置(zhi),綜(zong)合配置(zhi)工作力(li)(li)量,切(qie)實為(wei)基層減負增效(xiao)(xiao)創造條件。
深(shen)化(hua)開(kai)(kai)發(fa)(fa)區(qu)(qu)(qu)(qu)管理(li)(li)制(zhi)度改(gai)(gai)革。開(kai)(kai)發(fa)(fa)區(qu)(qu)(qu)(qu)建(jian)設(she)是(shi)我(wo)國(guo)改(gai)(gai)革開(kai)(kai)放的(de)成功實踐。自1984年黨(dang)中央、國(guo)務(wu)院決定在(zai)大連、秦(qin)皇島等(deng)地(di)設(she)立首(shou)批14個經濟技術開(kai)(kai)發(fa)(fa)區(qu)(qu)(qu)(qu)以(yi)來,各類開(kai)(kai)發(fa)(fa)區(qu)(qu)(qu)(qu)在(zai)深(shen)化(hua)經濟體制(zhi)改(gai)(gai)革、擴(kuo)大對(dui)外開(kai)(kai)放、加快產業發(fa)(fa)展、優(you)化(hua)營商(shang)環境等(deng)方面發(fa)(fa)揮了重要作(zuo)用。但也應看(kan)到,開(kai)(kai)發(fa)(fa)區(qu)(qu)(qu)(qu)類型多樣,涉及多個主管部門,一些開(kai)(kai)發(fa)(fa)區(qu)(qu)(qu)(qu)職(zhi)能(neng)定位不夠清晰、與屬(shu)地(di)行政(zheng)區(qu)(qu)(qu)(qu)職(zhi)責關系(xi)(xi)尚未(wei)理(li)(li)順,管理(li)(li)體制(zhi)有待(dai)完善。深(shen)化(hua)開(kai)(kai)發(fa)(fa)區(qu)(qu)(qu)(qu)管理(li)(li)制(zhi)度改(gai)(gai)革,要加強黨(dang)對(dui)開(kai)(kai)發(fa)(fa)區(qu)(qu)(qu)(qu)工作(zuo)的(de)全面領導,科(ke)(ke)學確定各類開(kai)(kai)發(fa)(fa)區(qu)(qu)(qu)(qu)的(de)區(qu)(qu)(qu)(qu)域布局、功能(neng)定位、發(fa)(fa)展方向和(he)數量規模。聚焦(jiao)經濟發(fa)(fa)展、產業發(fa)(fa)展和(he)投資服務(wu),賦予(yu)開(kai)(kai)發(fa)(fa)區(qu)(qu)(qu)(qu)更大的(de)自主發(fa)(fa)展、自主改(gai)(gai)革和(he)自主管理(li)(li)權(quan)限。科(ke)(ke)學確定開(kai)(kai)發(fa)(fa)區(qu)(qu)(qu)(qu)管理(li)(li)職(zhi)責,進一步理(li)(li)順開(kai)(kai)發(fa)(fa)區(qu)(qu)(qu)(qu)與屬(shu)地(di)政(zheng)府的(de)職(zhi)責關系(xi)(xi)。優(you)化(hua)開(kai)(kai)發(fa)(fa)區(qu)(qu)(qu)(qu)管理(li)(li)機(ji)構設(she)置,創新管理(li)(li)模式和(he)運行機(ji)制(zhi),提高管理(li)(li)效能(neng)。
